1. Terms

1.1 By submitting a registration for Meeting Place 2022 (MP22) (Event), you agree that the terms and conditions for this Event including ATEC’s Privacy Policy, which together form the Terms of Participation (Terms) for this Event, govern your participation.

1.2 ATEC may elect to vary these terms and conditions at their own discretion by providing you with notice at least 7 days before the changes or cancellation takes effect.

2. Organisation representation

2.1 All references to “ATEC”, “us” or “we” means Australian Tourism Export Council Limited, ABN 87 002 941 228, a company incorporated in Australia.

2.2. All references to “you” or “your” in these Terms means the organisation that is noted in the registration form that is registering for participation in the Event, and all rights conferred and obligations imposed on you in these Terms are deemed to have been accepted by and imposed on the organisation and its employees, agents and contractors. Any breach of these Terms by you, or any of your employees, contractors, licensees or invitees of your organisation constitutes a breach of these Terms by the organisation.

3. Registration and payment policy 

3.1 In order to be registered for the Event, each delegate must register and pay a participation fee as set out on the Event website.

3.2 Please refer to the Event website to note the items included in your registration.

3.3 Immediate payment is required to attend all ATEC events. We accept Mastercard and Visa only.

3.4 Credit card payments will incur a small surcharge of 1.25%.

3.5 If you are unable to pay via credit card, please contact events@atec.net.au noting full payment must be received by 31 October 2022. Any registrations made after this date must make payment prior to the event commencing. 

4. Cancellation policy 

4.1 If you are no longer able to attend an ATEC event, written notification of your cancellation must be emailed to events@atec.net.au.

4.2 Cancellations received prior to 31 August 2022 will receive a full refund.

4.3 Cancellations received between and including 1 September 2022 to 30 September 2022 will receive a full refund less a 20% administration charge.

4.4 Cancellations received between and including 1 October 2022 to 31 October 2022 will receive a 50% refund.

4.5 Cancellations received on or after 1 November 2022 will receive no refund. 

5. Attendee policy

5.1 You must be a financial ATEC member for the FY22/23 to attend this event.

5.2 If you are invited to join a waitlist for any reason, your place to attend is not formally confirmed until you are advised in writing by the ATEC team and full payment is received.

5.3 If 1:1 business to business (B2B) appointments are included as part of your registration, please note the number of appointments you ultimately receive via the system generated appointment schedule cannot be guaranteed.

5.4 Cancellations will not be accepted if you are not satisfied with your appointment schedule, for example, if you receive less appointments than anticipated or the quality of your appointments falls below your expectations.

6. Photography and filming

6.1 For promotional purposes, there may be a professional photographer and/or video production taking place during ATEC events. Delegates who do not wish to be filmed or recorded should advise the ATEC by emailing events@atec.net.au prior to the event.

6.2 Photos taken at ATEC events may be published online, available to download and used in marketing materials to promote the ATEC’s services.

7. Privacy and data sharing

7.1 ATEC collects your personal information when you choose to complete the event application form and provide your personal information to us with your consent. ATEC will use the personal information you provide to facilitate attendance at the event.

7.2 You acknowledge that your contact details may be shared amongst attendees at the event. If you do not wish for your details to be shared, please contact events@atec.net.au

8. Your obligations

8.1 ATEC does not:

8.1.1. Accept responsibility or liability for any loss suffered by participants or visitors.

8.1.2. Provide or arrange for any insurance for, or on behalf of, participants or visitors.

8.1.3. Provide any indemnity for loss or injury suffered by participants or visitors.

8.2 COVID-19: At a physical event, the health and safety of event participants and the broader community are important to us. In light of the COVID-19 pandemic and for purposes of your participation in the Event, you agree to:

8.2.1 Adhere to the relevant government health and work safety advice, including isolating if you are unwell or presenting symptoms such as fever, cough, sore throat, and/or shortness of breath;

8.2.2 Adhere to ATEC's and the operators' health and safety guidelines based on best practice and relevant government health and work safety advice; and

8.2.3 Undertake to sign and agree to documents or forms in relation to COVID-19 issued by ATEC and/or the event venue/organiser.

8.3 You warrant that:

8.3.1 You will at all times comply with all laws and obey the reasonable directions and requirements of ATEC, the STOs, Organisers and any other third parties as directed by ATEC;

8.3.2 You will not be involved in any conduct or make any statement either orally or in writing which in the reasonable opinion of ATEC, is likely to cause detriment, disrepute, damage, injury or loss to ATEC, including without limitation any inappropriate behaviour, harassment, violence, racial vilification, intoxication, downloading illegal or offensive material using internet services provided during the Event, or any other act or behaviour which interferes with the enjoyment, comfort or safety of other persons;

8.3.3 You will conduct yourself in a responsible and professional manner at all times;

8.3.4 You have full power and authority to agree to the Terms and observe the obligations hereunder, and that the acceptance, delivery and performance of these Terms has been duly and validly authorised by all necessary corporate action.

9. Disclaimer

9.1 ATEC may at any time, with or without giving notice, in their absolute discretion and without giving any reason, cancel or postpone the event, change its venue or any of the other published particulars, or withdraw any invitation or cancel any registration to attend. In any case, neither ATEC nor any of their officers, employees, agents, members or representatives shall be liable for any injury, loss, liability, damage or expense suffered or incurred by any person occasioned by or arising out of attendance at MP22 or any related event or activity.  ATEC has no obligation to return any money paid to it in connection with the conference unless ATEC is satisfied not only that the money in question remains under the control of ATEC but also that the person who paid it has been unfairly prejudiced (as to which, decision shall be in the sole and unfettered discretion of ATEC and, when communicated or announced, final and conclusive).

9.2 Without limiting the effect of clause 8.1, ATEC is not liable for any delay, variation of, or cancellation of the event or any obligation under this agreement, caused by the COVID-19 pandemic, or any policy, rule or law created in response to the pandemic by any of ATEC, a government, or government agency.

9.3 Without limiting the effect of clause 8.1, you acknowledge that these terms and conditions also apply to your participation in an event or activity organised as part of MP22 that is operated by a third party at any location or venue, whether it is paid for and arranged by ATEC or yourself, and agree that:

9.3.1 Use of third-party services may include activities that involve an element of danger, and these Terms and Conditions constitute fair warning of any such danger, and that ATEC recommends you take out comprehensive insurance with respect to such activities;

9.3.2 Neither ATEC nor any of their officers, employees, agents, members or representatives are liable for any injury, loss, liability, damage or expense suffered or incurred by you while participating in a dangerous activity or any activity organised in relation to MP22, whether operated by ATEC or a third-party;

9.3.3 ATEC is not responsible for any loss suffered by you due to any third-party being unable to fulfil an arrangement or obligation between themselves and you or ATEC;

9.3.4 Participation in events or activities operated by third parties may require you to agree to and be bound by those parties’ own terms and conditions.
